1. About these terms

These terms govern your use of this website and any content, tools or forms on it, including our eligibility check. They do not govern any loan we provide. If we approve a facility, the relationship is governed by the loan agreement, security documents and any related declarations you sign.

Where the loan documents and these terms conflict, the loan documents prevail.

2. No offer of finance

Nothing on this website is an offer of credit, a pre-approval, or a commitment to lend. Submitting an eligibility check or application does not create any obligation on us to provide finance, and does not entitle you to any particular amount, rate, term or fee.

All applications are subject to assessment, verification, credit and identity checks, and our credit approval. Any offer we make will be in writing, will set out the amount, term, repayment amount and fees, and will be capable of acceptance only in the manner and within the time stated in that offer.

3. Calculators and estimates

Any figures produced by a calculator, repayment illustration or example on this site are indicative only. They are generated from the inputs you provide, use assumptions that may not reflect your circumstances, and do not take into account fees or charges that may apply to your facility.

Indicative figures are not an offer, a quote, or a representation that finance is available on those terms. Your actual repayment amount will be the amount stated in your loan documents.

4. Business purpose only

We provide finance to companies and sole traders for business purposes only. Our loans are not regulated by the National Consumer Credit Protection Act 2009 (Cth) and are not available for personal, domestic or household purposes.

Before settlement you will be asked to sign a declaration confirming the purpose of the finance. See our Business Purpose Declaration for what that involves.

5. Applications and the information you give us

When you use the forms on this site, you agree that:

• the information you provide is true, complete and not misleading;
• you are authorised to provide it, including where it relates to a company, trust or another person such as a co-director or guarantor;
• you have that person’s consent for us to collect, use and disclose their personal information as described in our Privacy Policy; and
• we may verify what you tell us, including with credit reporting bodies, commercial credit bureaus, our identity verification provider, and by reviewing bank statements you supply.

We never ask for online banking logins or passwords. If you receive a request that appears to come from us asking for banking credentials, do not respond to it and contact us on the number on this site.

6. No advice

Information on this site is general in nature. It is not financial, legal, taxation or accounting advice, and it does not take account of your objectives, financial situation or needs. You should consider whether the finance is appropriate for your business and obtain your own professional advice before entering into any facility.

7. Acceptable use

You must not use this website to submit false, fraudulent or unauthorised applications, to impersonate another person or entity, to interfere with the site or its security, to scrape or harvest content or data, or for any unlawful purpose. We may suspend or refuse access where we reasonably suspect misuse.

8. Intellectual property

All content on this website — including text, layout, graphics, photographs, the GreyRok name and logo, and the design of our forms and documents — is owned by us or licensed to us and is protected by law. You may view, download and print pages for the purpose of considering or managing finance with us. Any other use, including reproduction, adaptation, redistribution or commercial use, requires our prior written consent.

9. Third-party links and content

This site may link to third-party websites, including those of credit reporting bodies and regulators. Those sites are not under our control. We provide the links for convenience and do not endorse, and are not responsible for, their content, availability, privacy practices or any dealings you have with them.

10. Availability and changes

We aim to keep this site available and its content accurate and current, but we do not guarantee either. We may change, suspend or withdraw the site, its features, our products, our eligibility criteria or our pricing at any time without notice.

We may also amend these terms. The version published on this site at the time you use it applies to that use. The date of the current version is shown at the top of this page.

11. Liability

To the maximum extent permitted by law, we exclude all liability for any loss or damage — including indirect or consequential loss, loss of profit or loss of data — arising from your use of, or reliance on, this website or anything on it.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where we may limit our liability, our liability is limited to re-supplying the relevant information or paying the cost of having it re-supplied.

12. Privacy

We handle personal information in accordance with our Privacy Policy, which includes our Credit Reporting Policy and explains the checks we carry out, who we disclose information to, and how to access, correct or complain about the information we hold.

13. Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that State and of the Commonwealth of Australia. This site is directed at businesses in Australia and is not intended for use in any jurisdiction where doing so would be unlawful.
